When can you modify child support?

On Behalf of The Law Office of Eric R. Little | Sep 10, 2024 | Divorce in Texas

Child support orders in Texas are meant to provide financial stability for children, but life circumstances can change over time. If your situation has significantly shifted since the original child support order was established, you may be eligible to request a modification.

Here, you can learn more about your legal options to request child support modification.

Significant changes in income

One of the most common reasons for modifying child support in Texas is a significant change in income. Whether you or the other parent has experienced a substantial increase or decrease in earnings can impact the child support amount. Texas courts typically consider a modification if the income change would alter the support amount by at least 20% or $100.

Changes in the child’s needs

As children grow, their needs may evolve. For example, if a child develops a medical condition or requires specialized care that wasn’t present during the initial order, the court may consider adjusting the child support to accommodate these new expenses.

Changes in custody or visitation

If there is a significant change in custody or visitation arrangements, this may also warrant a child support modification. For instance, if the parent paying support now spends significantly more time with the child, they may request a decrease in payments. Conversely, if the parent receiving support takes on more custody, they may seek an increase.

Time since the last modification

In Texas, there is also a time-based consideration for child support modifications. You can request a review of your child support order every three years, regardless of whether there has been a significant change in circumstances, as long as the new calculation would result in a $100 or 20% change.

Consulting with a family law attorney in Texas can help you understand your options and the best approach for your situation.
